The following terms and conditions are for the use of the www.Emissions-EUETS.com website (the Site), which is owned by Michał Głowacki (Law Firm of Michał Głowacki) - the Webmaster (the contact details are available here).

The Site is maintained for your personal use and viewing. Access and use by you of the Site constitutes your acceptance of these Terms and Conditions. This takes effect from the date on which you first use the Site.

Subscription Services

 

The following Terms and Conditions apply additionally to use of the subscription services (Subscription) at the Site and the materials and information it contains (Materials) by individual subscribers (Subscribers), by employees duly authorised by an organisation which is a Subscriber or any other person authorised by Webmaster (Authorised Users).

 

References to an Unauthorised Person mean any person who is not a Subscriber, or an Authorised User.

 

If you wish to receive access to the Subscription Services you will need to register with us.

 

By signing up to the Site you accept the Terms and Conditions.

 

Registered users receive access to restricted content at the Site (Subscription Services) and become Subscribers dependent on a non-refundable Subscription Fee (the price list available after registration).


Access is activated after the the Subscription Fee is credited to the Webmaster’s account. 

 

Subscribers registered as an EU VAT taxable persons should indicate in the payment document the VAT identification number.

 

If the Subscriber does not indicate this number in the payment document, the Webmaster will issue the invoice assuming that the Subscriber is not the EU VAT taxable person.

 

Payment document must also indicate the email address of registered user associated with the payment.
 

If you don’t pay for your Subscription on time, the Webmaster reserves the right to suspend the Subscription..

 

Some countries have mandatory local laws regarding your cancellation rights, and these terms doesn’t override these laws. Refunds are only issued if required by law.

 

The Webmaster may change the Subscription Fee in effect on renewal of your Subscription.

 

The invoices regarding Subscription are sent by email (as the pdf), after the the Subscription Fee is credited to the Webmaster’s account, to the email addresses indicated by the Subscriber while registering.

 

All payments must be made inclusive of value added tax or other similar tax where applicable.

 

The Webmaster reserves the right to decline any application from you to register at the Site in the sole discretion of the Webmaster and, in the event that the Webmaster declines your application, you will be refunded any prepaid fees paid expressly for your access.

 

While registering you should choose a Username and Password (please indicate the chosen Username in the payment document).

 

The Webmaster reserves the right to modify such or provide you with a username of our choice if, in the Webmaster’s sole opinion, such username infringes or violates the rights of any person or third party or is defamatory, profane, offensive, confusing or is in any other way improper or inappropriate.

 

You agree that you will not impersonate any other person or entity or use a false name or a name that you are not authorised to use, or disclose your password or username to any other person, or allow your password or user name to be used by any other person to access the Subscription. You are solely responsible for maintaining the confidentiality of your Password. You will be responsible for use of the Site via your Username and so will be liable for breach by anyone using your Password and/or Username.

 

The Webmaster reserves the right to terminate your account (including your Username and Password) if any personal information is found to be untrue, inaccurate, out-of-date or incomplete.

 

Authorised Users and Subscribers acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Site shall remain at all times vested in the Webmaster or the Webmaster’s licensors. You are permitted to use this material only as expressly authorised by the Webmaster or the Webmaster’s licensors.

 

Authorised Users and Subscribers acknowledge and agree that the material and content contained within the Site are made available for your personal use only. Any other use of the Materials and content of the Site is strictly prohibited, save as expressly permitted in these Terms and Conditions.

 

Authorised Users and Subscribers may use the Site for their own private or business research, and for this purpose may:
a. display the Materials on screen;
b. make printouts of items included in the Materials;
c. download and store in machine readable a single copy of insubstantial portions of the Materials primarily for one person’s exclusive use.

 

Users and Subscribers may not:
a. make multiple printouts or copies of Materials for distribution to Unauthorised Persons;
b. re-sell the Site or any part of the Materials to others;
c. make the Site or any Materials available to Unauthorised Persons on a local area network, a wide area network or on any intranet or extranet;
d. abstract, download, store, reproduce, transmit, display, copy, distribute or use the Materials other than as permitted above;
e. use the Site for any illegal purpose nor send or post or allow any posting of information which is defamatory or obscene or which violates the legal rights of others, nor use the Site to send any unsolicited promotional or advertising material, or any volume messages which may interfere with the provision of the services by the Site or the enjoyment of the Site by other users.

 

Usernames and Passwords must not be made available to Unauthorised Persons for the purpose of using the Site. If we suspect that a Username and Password is being used by an Unauthorised Person we may cancel it.

 

Authorised Users and Subscribers acquire no proprietary interest in the Site or Materials and except as expressly permitted by these terms and conditions and may not use the Site or the Materials in any way that infringes the intellectual property rights in them.

 

We reserve the right to suspend or terminate your access to the Site with notice to you if:
(a) you’re in breach of these Terms and Conditions,
(b) your use of the Site would cause a real risk of harm or loss to us or other users, or
(c) you have registered and don’t have a paid account for 12 consecutive months.

 

We’ll provide you with reasonable advance notice via the email address associated with your account to remedy the activity that prompted us to contact you.

 

If after such notice you fail to take the steps we ask of you, we’ll terminate or suspend your access to the Site.

 

We won’t provide notice before termination or suspension of access to the Site where:
(a) you’re in material breach of these Terms and Conditions,
(b) doing so would cause us legal liability or compromise our ability to provide the services of the Site to our other users, or
(c) we're prohibited from doing so by law.

 

We may decide to discontinue the services of the Site in response to exceptional unforeseen circumstances, a change in the business model, or to comply with a legal requirement.

 

If we discontinue the Services in this way before the end of any fixed or minimum term you have paid us for, we’ll refund the portion of the fees you have pre-paid but haven't received services for.

Jurisdiction


These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Poland. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Republic of Poland.

Variation

The Webmaster may at any time revise these terms of use without notice. Please check regularly. Continued use of the Site after a change has been made is your acceptance of the change.

Severance

If any part of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Terms and Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of these Terms and Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstance.

Entire agreement

These Terms and Conditions may be amended from time to time, they contain the entire agreement relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, in relation to such matters.
