Energy Package

 


 

 

The Third Energy Package is comprised of the following legal instruments:

 

- Directive 2009/72/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in electricity and repealing Directive 2003/54/EC (OJ L 211, 14.08.2009, p. 55),

 

- Regulation (EC) No 714/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the network for cross-border exchanges in electricity (OJ L 211, 14.08.2009, p. 15, as amended),

 

- Directive 2009/73/EC of the European Parliament and of the Council of 13 July 2009 concerning common rules for the internal market in natural gas and repealing Directive 2003/55/EC (OJ L 211, 14.08.2009, p. 94),

 

- Regulation (EC) No 715/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the natural gas transmission networks and repealing Regulation (EC) No 1775/2005 (OJ L 211, 14.08.2009, p. 36, as amended),

 

- Regulation (EC) No 713/2009 of the European Parliament and of the Council of 13 July 2009 establishing an Agency for the Cooperation of Energy Regulators (OJ L 211, 14.08.2009, p. 1, as amended).

 

The Third Energy Package pursues the general objective of completing the European Union Internal Energy Market (IEM) contains provisions on a number of aspects related to electricity and gas supplies and covers in particular the following areas:


- unbundling energy suppliers from network operators;


- strengthening the independence of regulators;


- establishing the Agency for the Cooperation of Energy Regulators (ACER);


- enhancing cross-border cooperation between transmission system operators and the creation of European Networks for Transmission System Operators (ENTSO-E and ENTSO-G);


- open, fair retail markets and consumer protection,

 

- contract switching,

 

- contract termination fees,

 

- billing of electricity and gas consumption,

 

- the right to receive information on energy consumption,

 

- quick and cheap disputes resolution.


With regard to consumer protection, the Third Energy Package prescribes the EU Member States to define the concept of vulnerable consumers at the national level and adopt the measures to protect such consumers and to address energy poverty.
